These terms must be read with our Website Terms and Community Guidelines, Terms of Use and our other policies and terms available on our website.

All users and our service providers are bound by the terms and conditions of this Privacy Policy and applicable data protection laws. We may update this policy from time to time. We will notify you of any updates to this Privacy Policy and you will regularly check our website for such updates.

The words “include”, “including” and “in particular” are by way of example only and shall not limit the generality of any preceding words.

Who We Are:

We are Ticket Spot, an online ticketing platform, through which event organizers ("Organizers") can promote and sell tickets for events. Ticket Spot is operated by Blaque Boss Hustle (Pty) Ltd, a private company registered in South Africa with registration number 2021/442402/07 (“Ticket Spot”, “we”, “us”, “our”).
 

This privacy policy sets out how we handle data that we collect from:

  1. Organizers.

  2. account holders who want to buy tickets, or register for events, or donate to events ("Buyers"); and

  3. other users or visitors to our website,

(“user”, “you”, “your”, “yours”). 

 

We act as a data processor and a data controller: As a data controller, we decide how and why your data is used. As a data processor, we process your data on behalf of Organizers, following their instructions, which allows Organizers to manage their events. In both roles, we prioritize your data's security.

The Data We Collect & Where We Get It:

We collect and store different types of data directly and indirectly depending on how you interact with us.

  1. When you create an account, purchase a ticket, fill out a survey, and/or make a donation through our site as a customer, we use the data you provide to fulfil our and the event Organizer’s obligations in delivering the service to you. This data may include your contact and billing information (name, address, email address, phone number, accessibility information, and payment details*), and other data necessary for the relevant event. With your consent, event Organizers may, through the Ticket Spot platform, also update you about other upcoming events.

  2. When you engage us as an event Organizer, we use the data you provide to onboard (e.g., KYC purposes) you and fulfil our contractual obligations to you. *

  3. When you browse our site or app, we may use cookies to allow our website to function and/or to improve your experience of our website. If you agree, we may use non-essential third-party cookies when you visit our website via a third-party platform (such as Facebook) to track site use or for re-marketing, but you may opt out of this at any time.

  4. When you contact our customer service team, we may record the communications to manage your queries and provide you with the best support.

In most circumstances, providing your personal data to us is voluntary. Sometimes it may be mandatory to provide your personal data to us and we may not be able to provide the services you requested from us or we may be prevented from complying with our legal obligations if you fail to provide the information we require.  If you do not agree to the terms of this privacy policy, or parts of this privacy policy, please do not submit any of your personal information to us. 

 

*We will only request payment details through a secure third-party payment platform. Before making any payment, you must always verify that the payment gateway is correct and secure. Be careful of any emails from unknown or external senders, and do not open any suspicious links or attachments.

How & Why, We Use Your Data:

We only collect and process data where we have a legal basis to do so, and in compliance with this Privacy Policy and data protection laws:

1. For the performance of our agreement with you

  • To process the online sale of tickets for, or donations to events, sending booking confirmations, event reminders, take payments and provide customer support to you.

  • To share data with Organizers so that they can manage events, allocate seats, notify you of event information and updates.

​

  • To limit fraudulent activity.

​

This includes information which identifies you, such as names, email addresses, information regarding the event for which a ticket is purchased or a donation made, the type of ticket purchased, the ticket price, and financial information so that online payments may be facilitated.

 

2. For our legitimate business interests

Where permitted:

  • To notify you of upcoming events.

​

  • To conduct research and get feedback from you.

​

  • To tailor content based on your preferences.

​

Data enables us to operate our ticketing platform and provide the ticketing services we offer, which may include (on a case-by-case basis, as necessary in the circumstances) your: 

  • Name

  • Email address

  • Credit Card Information of a Buyer

​

  • Bank Details of an Organizer, or a Buyer

​

  • Password

​

  • Username

​

  • Year of Birth or Age

​

  • Contact Information submitted by the user

  • Information submitted by a user as part of a support request.

We, or our third-party service providers, may contact you regarding products or services you have signed up for or purchased from us, such as may be necessary to deliver transactional or service-related communications. We may also contact you with offers for additional services we think you'll find valuable, but only if you have given us express consent to do so.

 

Even if you initially gave consent, you may at any time withdraw your consent to marketing communications by following the steps indicated in any marketing communication from us. Please refer to the relevant item detailing your rights below.

 

We may also collect indirect information from you to maintain our website’s basic functionality, or to anonymously track what you do on our website, in the form of cookies. This includes IP addresses, and web browser information.

 

3. To override legitimate business interests

  • To prevent fraud.

When you create an account with Ticket Spot, you are asked to consent to us collecting and processing data in accordance with this policy.

If you are not an account holder, you will be asked to consent to us collecting data submitted by you during the ticket purchase process.

Non-essential cookie consent may be given once you visit our website for the first time. Your consent may be withdrawn at any time, but only in relation to the processing of data, which is not necessary for our website to function, for a valid transaction to be concluded via our website, or as part of our legitimate interest in operating our ticketing platform and providing the ticketing services we offer.

5. Where we have a legal duty

We collect and process data to comply with legal and regulatory requirements, and any court order. This also includes any data necessary for compliance with legal obligations, such as financial information for tax purposes.

 

6. To protect vital interests

We may process data to protect the vital interests of the data subject or another person. This includes any data necessary in an emergency situation where the life or health of an individual is at risk, which we may also share with government officials for health compliance.

7. In public interest

If applicable, we may process data to perform tasks carried out in public interest or in the exercise of official authority vested in us. This includes any data necessary for the performance of such tasks.

Who We Share Data With & Why We Share Data:

Further to the above, we may share your data with:
 

  • Our contractors / service providers/partners: For marketing (where you have given consent), reporting, technical support, cloud hosting, payment processing, customer support services, and information security. These service partners are subject to strict data processing terms and conditions and applicable data protection laws.
     

  • Organizers: To manage and run events. Organizers are also subject to strict data processing terms and conditions and applicable data protection laws.

  • Commercial partners: To provide additional services, such as refund insurance coverage.

​

  • Successors: Our successor/s, if there is a business sale or restructuring.

​

  • Government organizations: To comply with legal requests and investigate fraud.

 

Where we share your data with a party in a country outside of South Africa, we will do so in accordance with data protection laws, and we will ensure adequate safeguards are in place to protect your data.

The hosting, analytics, email sending and other technical provisions for our website and mobile app may be hosted on servers outside of South Africa or outside of the European Union. However, we ensure that our host providers are subject to laws, or policies, which uphold principles for the reasonable processing of information substantially similar to the data protection laws applicable to the European Union and/or in South Africa to ensure adequate protection of any such data.

Your Rights & Choices:

In respect of your personal data, you have rights relating to automated decision-making and profiling, and the right to:

  • Access - Request a copy of your data (free of charge, unless your request is manifestly unfounded or excessive).

  • Correct - Correct inaccurate or incomplete data.

​

  • Delete - Request deletion of your data in certain circumstances.

​

  • Restrict - Request restriction of data processing.

​

  • Portability - Transfer your data to another organization.

​

  • Object - Object to processing for direct marketing, automated processing, and profiling.

You also have the right to complain to a relevant supervisory authority regarding the use of your data by us. In South Africa, the relevant supervisory authority is the Information Regulator (please see www.inforegulator.org.za).

How can you change or delete data?

​

You may correct your inaccurate or incomplete personal data at any time. For account users, the easiest way to change your information is to log into your Ticket Spot account, edit your account settings, and save your changes. If you make a request to delete your personal data, we will honor your request and notify the relevant third-party service providers without undue delay subject to certain exceptions. Your request will be actioned only if your personal data is no longer necessary for the purposes for which it was collected or otherwise processed, or where there are no overriding legitimate grounds for its processing. We may retain your personal data where necessary for (i) compliance with a legal obligation, (ii) performance of a task carried out in the public interest, or (iii) establishment, exercise, or defense of legal claims.


Users can "opt out" of receiving Ticket Spot newsletter emails by clicking on the "unsubscribe" link in newsletter emails. We will process your request to unsubscribe as quickly as possible.


Please note that users cannot unsubscribe from Ticket Spot Service communications via the website but should contact us at admin@ticketspot.co.za in order to request the closing of an account.

How We Protect Your Data:

We implement security measures to protect your data and ensure it is deleted once it is no longer needed. 

If you know or suspect that an unauthorized account has been created using your data, you must contact us immediately.

Retention Periods – How Long We Keep Your Data For:

  • Your Account: We keep your account details and purchase information for as long as your account is active.

​

  • Consent: We delete data processed with your consent upon withdrawal of your consent. 

​

  • Safety & Security: We maintain limited information to prevent fraud and ensure security.

 

Data Security:

All data provided to us is stored on our secure servers or those of our trusted partner services, acting as our data processors or sub-processors.

We implement industry-standard technical, organizational and security measures and safeguards to protect the data we collect from unauthorized access, disclosure, alteration, accidental loss, unlawful processing, damage or destruction including (but not limited to) encryption where appropriate.

Please note that we may transfer data outside of the Republic of South Africa as permitted.

Where necessary, we conduct regular risk assessments and Data Protection Impact Assessments (DPIAs). These assessments are conducted where a type of personal data processing is likely to result in a high risk to the rights and/or freedoms of people, such as processing that uses new technologies. Additionally, we continuously monitor and review our data protection practices and transfer mechanisms to ensure compliance with applicable data protection laws.

Unfortunately, the transmission and storage of information via the internet is not always completely secure. We are committed to implementing appropriate measures to protect your personal information in accordance with applicable data protection laws, but we cannot guarantee 100% security of your data transmitted to our servers.

Our website may contain links to third-party websites. We are not responsible for the privacy practices or the content of third-party sites. You must carefully read the privacy policy of any website you visit.

Organizer Responsibilities:

Organizers must always comply with this Privacy Policy and the Organizer Terms of Use.

​

Organizers are responsible for the information submitted by them and acknowledge that this information will be displayed publicly.

​

Organizers are bound to treat data in accordance with this privacy policy and any applicable data protection laws (including GDPR and POPIA). 

​

While Ticket Spot will take all reasonable steps to ensure that Organizers comply with relevant data protection laws in respect of your data, Organizers act as independent data controllers and are separately responsible for their compliance with applicable data protection laws. 

​

Ticket Spot will take reasonable steps to ensure that any personal data shared with Organizers is processed in compliance with applicable data protection laws. This includes agreeing appropriate data processing terms with Organizers that mandate their compliance with applicable data protection laws. 

 

Organizers who have received a Buyer’s data in accordance with this privacy policy may continue to use that data to contact a Buyer in accordance with their own privacy policies (which must comply with applicable data protection laws and disclose how data will be used and data subject rights), but they may not use Ticket Spot's system to do so.

You must review the applicable policies of the Organizers of an event before providing personal data or other information in connection with that event. By purchasing a ticket, you expressly consent to the sharing of your data with the Organizer for the disclosed purposes.

 

Service Providers Responsibilities:

​

We may share personal data with trusted third parties as necessary for them to perform services on our behalf, such as processing credit card payments. 

​

We will enter into the necessary data processing agreements with these third parties in compliance with applicable data protection laws and we will only engage with third party service providers that can provide sufficient guarantees about their ability to implement appropriate technical and organizational measures to comply with legal requirements and protect the rights of the data subjects. 

​

These third parties (and any subcontractors) are subject to strict data processing terms and conditions and are prohibited from using, sharing or retaining your data for any other than those set out in this Privacy Policy.

We will share transaction data with our payment service providers or bank only to the extent necessary for the purposes of processing payments, refunding payments, transferring money to a user, and/or dealing with user queries and complaints relating to such payments, refunds and transfers.

Children's Data:

​

No child under 18 years of age ("Child") may use our website, services or submit any data to us under any circumstance whatsoever. 
 

A user ("Submitter") may only submit to Ticket Spot personal data relating to a Child if that user (a) is the holder of parental responsibility over such Child or (b) has obtained the requisite consent and authorization from the holder of parental responsibility over such Child to do so.

By using our website and/or our services, the Submitter verifies that either (a) or (b) above is true. 

​

If you are a parent of a Child and become aware that your Child or an unauthorized person has provided your Child's personal data to us, please contact us immediately.

If we learn that a Child's personal data has been unlawfully submitted to us, we will take reasonable steps to delete the Child's personal data promptly and inform the Child's parent or guardian of the situation.

Ticketspot Refund Policy

Please note that refunds are not guaranteed for every event and are at the discretion of the event organizer.

​

If refunds are allowed by the organizer, and in the case of cancelled or postponed events, please note that the Ticketspot booking fee is always non-refundable, and our commission will be deducted from the face value of the tickets being refunded.

 

If the organizer for the event has permitted refunds, you can cancel your order by emailing admin@ticketspot.co.za with the email address that was used to make the booking as your reference and please explain your reason for cancelling.

 

No refunds will be permitted within 72 hours of actual event.

 

Please note that the Ticketspot booking fee is always non-refundable, and our commission will be deducted from the face value of the tickets being refunded.

 

If you had a free booking and did not make any payment for your order, you will not be charged any fees, and your tickets will simply be cancelled.

Event cancellations or postponements

Sometimes an organizer may need to cancel or postpone an event for reasons out of their control. If this happens, all ticket buyers will be notified via email that the event has been cancelled or postponed with information regarding refunds.
